In accordance with Article 33 of the Minister of Communication and Informatics Regulation Number 3 of 2024 on the Certification of Telecommunication Equipment and/or Devices, and in line with efforts to supervise such equipment, the Ministry of Communication and Digital Affairs has prepared a Draft Ministerial Decree concerning the List of Telecommunication Equipment and/or Devices Required to Comply with Technical Standards.

          The key elements of the draft decree include:

• Establishing a list of telecommunication equipment and/or devices, including other tools or devices with telecommunication features, that are required to meet technical standards.
• The list is structured based on harmonized system (HS) codes in accordance with applicable laws and regulations.
• The inclusion of HS codes in this decree serves solely as an administrative instrument for oversight and is not intended as a reference for determining HS codes during customs clearence processes.
• Any Telecommunication equipment and/or devices, including those with telecommunication features, not listed in the annex of this decree are still subject to compliance with applicable technical standards.
• The draft decree will come into effect 30 (thirty calendar days from the date of its enactment.

          In line with Article 46 of Law Number 30 of 2024 on Goverment Administration, which mandates that goverment institutions conduct public outreach before finalizing decisions, the Ministry of Communication and Digital Affairs hereby invites stakeholders to review and provide feedback on this draft decree.
